REGULATORY UPDATE - NOTIFICATION OF REQUIREMENT TO REGISTER PROJECTS WITH ENTRUST
As you are aware the Landfill Tax (amendment) Regulations 2007 brought in further changes to the Landfill Tax Regulations 1996. The new regulations, allow ENTRUST to:
Regulation 34 4(2)
“(aa) may:
(i) at the time a body is approved, or
(ii) subsequently, by notice delivered to that body,
impose such conditions as it sees fit”.
Accordingly under regulation 34 4(2) (aa) of the Landfill Tax Amendment Regulations 2007, ENTRUST is imposing the following condition on all Environmental Bodies without exception:
Any environmental body must notify and register with the Regulatory Body, as defined within the Landfill Tax Regulations 1996 (‘the Regulations’), in writing of any project details in advance of spending or entering into any contract/obligation which imposes a liability on an environmental body to spend on a project. Any spend which is made on a project which has not been notified and registered with and approved in writing by the Regulatory Body will not be deemed to have been spent on an approved object and will be deemed to be non-compliant expenditure under the Regulations.
