The deadline for responses to the consultation on Object D is 06 August 2010. ENTRUST is holding a consultation on Object D and is inviting all EBs to give their views on this topic. We would like to thank all EBs who have responded so far and would invite all other EBs to have their say.
ENTRUST last consulted on Object D in 2008 and HMRC advised that we should review our guidance. We have taken legal advice, reviewed our new interpretation with HMRC and taken advice from HMRC on the practical implementation of the changes we propose within this consultation.
The change to the interpretation of the word ‘amenity’ will happen immediately and has led to a revision of the guidance and the Form 2 – Object D Appendix. Our consultation on this element is primarily about the clarity of the new guidance.
As a result of the revised interpretation of an amenity, you are also invited to resubmit any applications for projects which were previously declined where you feel that they would be compliant under the revised interpretation.
The enclosed consultation document also sets out guidance on the interpretation of the element of the Regulations on Object D that relates to projects being able to demonstrate that the park or amenity which is being provided, maintained or improved is for the protection of the environment. We will review the responses before considering if this should be implemented.
